El observatorio ciudadano Destapando el Pacto es la única plataforma que ilumina lo que algunos quieren mantener en penumbra, es decir, las negociaciones entre el Ministerio de Educación (MINEDUC) y el Sindicato de Trabajadores de la Educación (STEG) sobre el nuevo pacto colectivo de educación. Figuras como Joviel Acevedo, se han esforzado por negociar a puerta cerrada e impedir a los medios y a los ciudadanos el conocimiento de las negociaciones para el nuevo pacto.
No dejemos que nos mantengan en la oscuridad e iluminemos la educación. Este apartado incluye las actas firmadas que definen las condiciones de trabajo del nuevo pacto colectivo de educación y una detallada comparación con el pacto vigente para facilitar a los ciudadanos la información que no ha salido a la luz… hasta ahora.
Como Movimiento Cívico Nacional hemos tomado la iniciativa de transparentar estas negociaciones presentando solicitudes de acceso a la información pública para que las negociaciones de este pacto colectivo, cuyos resultados impactan directamente la calidad y el futuro de la educación de todos los guatemaltecos, sean visibles.
La educación es la base sobre la cual se construye nuestra República. Cumplir el sueño guatemalteco de un país más justo, próspero y transparente solamente es posible con una educación sólida y si se cumplen los principios más básicos de máxima publicidad de los actos administrativos. Actualmente el borrador del pacto colectivo o pliego de peticiones de este pacto está bajo reserva de confidencialidad, a pesar de no cumplir con los requisitos legales para ello y peor aún, nos deja en la oscuridad. Los ciudadanos no sabemos cuál es la base sobre la que se está negociando el pacto colectivo de educación y no hay publicidad acerca de qué sucede en las negociaciones. ¿Cómo podemos garantizar el buen funcionamiento de nuestras instituciones y de la educación si no tenemos el derecho de saber qué están haciendo con los recursos y el futuro de nuestra nación?

A inicios del 2024 Joviel Acevedo se aseguró de garantizar que las negociaciones del nuevo pacto fueran a puerta cerrada. Sabemos que estas sesiones son fundamentales para definir el destino de la educación en Guatemala, pero ¿cómo podemos estar seguros de que se están tomando las mejores decisiones si no hay publicidad ni transparencia?
El observatorio es una luz para todos los ciudadanos que buscan alumbrar la educación y conocer más sobre el pacto. Es importante porque todos los guatemaltecos pueden encontrar en una sola plataforma los resultados de todas las sesiones de negociación. Además, la fiscalización del nuevo pacto colectivo de educación es necesaria para garantizar la máxima publicidad de los actos administrativos.
La mejor forma de proteger la República es la transparencia en el manejo de los recursos públicos y garantizando el respeto al derecho al acceso a la información.
El observatorio fiscaliza las negociaciones del pacto colectivo de educación. Podrás encontrar las actas que nos han sido entregadas a través de solicitudes de acceso a la información hasta la fecha, las personas que asistieron a las sesiones de negociación (y la institución que representan); el resumen de la negociación; una comparación entre artículos del pacto colectivo pasado y el que se está negociando; así como un análisis del impacto de esta negociación colectiva.
No dejemos que el futuro de los niños y jóvenes guatemaltecos quede en la oscuridad. Destapemos el pacto y garanticemos que la educación de Guatemala sea manejada con la transparencia que merece. Article 69. For the calculation of the payment of unused vacation benefits at the end of the employment relationship, these will be paid at a rate of one full nominal monthly salary without deductions, for each period of vacation worked, recognizing a maximum of 5 unused periods and proportionally in the event of not having completed the year. In this sense, it is considered that the 5 unused vacation periods recognized in this article are complete periods and their count must begin from the most recent complete unused period and only if the applicant does not have 5 unused periods, the possibility of taking into consideration the incomplete period for pro-rata payment is enabled. |

For workers who retire from service by availing themselves of retirement, MINEDUC will grant them an economic benefit equivalent to one monthly salary until the corresponding pension or retirement agreement is issued, provided that it does not exceed four salaries. In this regard, the entities responsible for these procedures are obliged to resolve them as established by law. To enjoy this right, workers must give notice of their retirement at least 5 months in advance and must have submitted their retirement file, including a simple photocopy of the settlement approved by the Comptroller General of Accounts with its respective notification. The aforementioned notice cannot serve as a basis to diminish, misrepresent, or deny any right to MINEDUC workers. Workers will also not lose any rights granted in this Agreement or other laws if they initiate the Provisional Settlement process with the Civil Service authorities in due anticipation. |

In compliance with the provisions of Convention 9 of the International Labor Organization -ILO- and Legislative Decree 59-95, for the purposes of compensation for unfair dismissal or termination unilaterally decided by MINEDUC or unfairly, the worker will receive the equivalent of one month's salary for each year of continuous service provided, not exceeding ten months' salary. Additionally, under the same circumstance mentioned in this article, for workers who have more than 10 years of continuous service, an economic benefit will be recognized as compensation starting from the eleventh year, one nominal monthly salary for each year worked continuously, which cannot exceed 10 years, to which the respective bonuses enjoyed in the last 6 months of the employment relationship must be added. Without prejudice to other economic benefits to which they are entitled. |

Article 63. Post-mortem compensation. MINEDUC will grant the family members of its deceased employees a sum equivalent to ten salaries. For this purpose, the last nominal salary received and the beneficiaries indicated by the person who rendered services to the Ministry will be considered. The beneficiaries of workers who died due to civil war will not enjoy this benefit. Workers must indicate which persons will benefit from this benefit, and for those who have not done so due to very particular situations, this benefit will be granted to the spouse, children, or, if applicable, the person with whom they were in a de facto union at the time of their death. |

Article 64. Salary adjustment. MINEDUC considers the dignification of workers to be a fundamental element in providing services to the general population. It is a special consideration that for the years 2021 and 2022 there will be no salary adjustments. It commits to including in the 2023 budget an adjustment of 3% on the current basic salary starting from January 1 of that year. It is clarified that the restriction of negotiating economic benefits as percentages of the initial salary and the total salary of existing job classes, functional titles, and wages does not apply in this matter, due to the agreement having been denounced as corresponds by law in 2020 when the aforementioned was not in force. |

| Article 66. STEG commits to ensuring that, jointly with MINEDUC, once the objectives of the Academic Program for Professional Development of Physical Education Teachers -PADEP/F- have been met, a Professionalization Bonus of Q700.00 per month will be granted to them starting January 1, 2022. This bonus will also be granted to professors who have graduated from the Initial Teacher Training -FID- established in Ministerial Agreement 3452-2017, and who join the Ministry of Education as teachers. To enjoy this benefit, workers only need to accredit their graduation with a legalized copy of their Graduation Certificate to the Human Resources department of the corresponding Departmental Directorate, which will immediately inform the relevant authority so that the Professionalization Bonus can be granted. The Union of Education Workers of Guatemala, STEG, will ensure the proper fulfillment of the programs and will carry out monitoring and evaluations of the services it deems convenient, which must be improved according to the State's possibilities, and which must include all levels of the Public Education System. Resumen
MINEDUC delegates gave a general presentation on the progress of the discussion of the Collective Bargaining Agreement draft; they also informed the board of the progress in the negotiation roadmap regarding articles with economic impact; and finally, they requested that STEG delegates discuss the articles that remained pending approval, due to the reasons stated in the minutes by the Minister of Education. In this regard, Article 72 of the draft was discussed, but no consensus was reached on its wording, so STEG delegates would present an alternative proposal at the next meeting.

Resumen
Following up on what was agreed upon in the session on February 5th of this year, where Article 72 of the draft was discussed, and since no consensus was reached on its wording, the STEG delegates indicated that they would present an alternative proposal in this session. The members of the MINEDUC negotiating committee asked the STEG committee if they would present the alternative proposal for Article 72 of the draft and also requested to continue with the discussion of the articles that were pending approval due to the reasons stated in the minutes by the Minister of Education. In response to the above, the STEG representatives indicated that they requested to address the articles related to economic issues, and discuss the articles referred to by the MINEDUC committee at the end, to which the employer committee indicated that they would make the corresponding consultations, as they consider that in order to advance in the discussion of the draft, it is pertinent to address the pending non-economic issues. The parties agreed that the session on February 19th of this year would not be held, due to the inauguration of the 2025 school year.

Resumen
MINEDUC delegates reported on the actions they are taking before presenting the counterproposal to the articles related to economic issues; likewise, they reiterated the requests made in previous sessions, consisting of the fact that, in order to advance in the discussion of the project, it is considered pertinent that pending issues that are not of an economic nature be exhausted. In response to what was requested, STEG representatives stated that they reiterate the position assumed in the previous session on February 12 of the current year, since, in a meeting held with the secretaries of the departmental sections, it was agreed that the economic proposal presented should be discussed first and subsequently, the remaining articles.
